Today, President Bola Ahmed Tinubu presented his government’s 2026 Appropriation Bill before the National Assembly. This, in itself, is a routine but important constitutional exercise. Yet embedded within the address was a far more consequential declaration: that from this moment onward, any Nigerian found wielding a gun—outside state actors—would be treated as a bandit or terrorist. It is this assertion, rather than the budget figures, that demands careful scrutiny.

At a conceptual level, the impulse behind the statement is understandable. Nigeria’s deepening insecurity, the proliferation of small arms, and the state’s waning monopoly over violence have produced legitimate public anxiety. Few would dispute the necessity of stronger, clearer gun control. The difficulty lies not in the objective, but in the framing. The president’s declaration collapses critical legal and historical distinctions that cannot simply be wished away by executive rhetoric.

The immediate problem is definitional. Does this sweeping pronouncement include dane guns—long embedded in local hunting cultures and previously regulated under existing law? Does it apply to firearms that were lawfully acquired and properly licensed before today? These are not marginal questions; they go to the heart of legality. A policy that fails to differentiate between illicit military-grade weapons and firearms legally obtained under prior regulatory regimes is not merely blunt—it is legally incoherent.

Here, constitutional reality intervenes. The president cannot make law by fiat. No matter how emphatic the speech, firearms regulation remains a legislative matter. Any binding change must pass through the National Assembly, subjected to debate, drafting, amendment, and enactment. This is not procedural pedantry; it is the difference between governance and arbitrariness.

Judged on the speech alone, implementation would be deeply problematic. Nigeria’s security architecture is notoriously prone to interpretive excess. In the absence of precise statutory guidance, overzealous enforcement agents will predictably exploit ambiguity—arresting citizens, detaining them without due process, and turning uncertainty into opportunity for abuse. Yet such actions would not stand. Both the security agencies and, by extension, the presidency would almost certainly lose in court.

The reason is elementary but decisive: no law has retroactive effect. If a citizen can demonstrate that a firearm was lawfully acquired and duly licensed under existing regulations before any new law takes effect, criminal liability collapses. Courts will not uphold punishment for conduct that was legal at the time it occurred. Any attempt to do so would amount to a fundamental violation of constitutional principles and settled jurisprudence.

If the administration is serious about addressing arms proliferation, then seriousness must take legislative form. The president must approach the National Assembly with a draft bill that does the hard work his speech avoided: clearly classify categories of firearms; distinguish between prohibited weapons and regulated ones; provide for buy-back, amnesty, or compensation schemes; and include transitional provisions that protect legitimate gun owners from criminalization. Only such a framework can balance public security with the rule of law.

Handled this way, gun reform could finally confront Nigeria’s most glaring contradiction—the impunity with which certain groups, particularly armed cattle herders and other non-state actors, openly carry and use weapons without consequence. Without legislative clarity, however, the declaration risks becoming another episode in Nigeria’s long history of forceful pronouncements undermined by legal reality.

In short, rhetoric may signal intent, but only law can produce order. Anything less will deepen mistrust, invite abuse, and weaken the very authority the state seeks to reclaim.
